1. Purpose of the tenancy, conclusion of the contract, terms of payment: The property is intended solely for private holiday use and must not be used for commercial purposes. By signing, the tenant confirms their legal capacity to act and enter into a contract. The deposit, final payment, and any security deposit are set out in the contract. If the signed contract or payments are received late, the landlord may let the property to another party without any obligation to provide a replacement. The property may only be occupied by the persons named in the contract. Subletting and assignment of the tenancy are prohibited.

2. Service charges Service charges are included in the rent, unless expressly stated otherwise in the contract: Any costs not included must be settled in cash, via Twint, or by bank transfer at the end of the tenancy period. Tourist taxes and accommodation fees must be paid separately to the Sörenberg Tourist Office (Chalet). For the apartments in Saas-Fee, the landlord organizes the Saastalkarten and settles the visitor’s tax and accommodation fees directly with the Saas-Fee Tourist Office. Payment is therefore made via the landlord, who provides the statement and Saastalkarten to the tenants.

3. Security deposit: Any security deposit serves to cover ancillary and cleaning costs as well as damage. The deposit will be settled at the end of the tenancy. Any shortfall in favor of the landlord must be settled within 10 days.

4. Arrival and handover: The property will be handed over clean and in accordance with the contract. Any defects must be reported immediately; otherwise, the property is deemed accepted in perfect condition. In the event of late arrival, the full rental price remains payable.

5. Household members and guests: The tenant is responsible for ensuring that their guests also comply with the terms of the contract.

6. Careful use: The property may only be occupied by the number of people specified in the contract. Pets are only permitted with express consent. Any damage must be reported immediately. In the event of serious breaches, the contract may be terminated without notice.

7. Return of the rental property: The property must be returned in a clean condition, unless final cleaning has been agreed. The tenant is liable for any damage and missing items.

8. Cancellation and early return: The following fees apply in the event of cancellation: I) Up to 90 days before arrival: CHF 100; II) 89 to 31 days before arrival: 50% of the rental sum; III) Less than 30 days before arrival: 100% of the rental sum. The tenant may propose a reasonable replacement tenant, but the landlord must agree. In the event of early return, the full rent remains payable.

9. Force majeure: In the event of force majeure, the landlord may offer an alternative property. If this is not possible, the rent will be refunded on a pro rata basis. Further claims are excluded.

10. Tenant’s liability: The tenant is liable for all damage caused by them or their guests. 11. Landlord’s liability The landlord is liable for performance in accordance with the contract, to the extent permitted by law. They are not liable for unforeseeable events, force majeure, or for information regarding infrastructure and services.

12. Data Protection: The tenant’s data will be processed in accordance with Swiss data protection law. It may be passed on to third parties if this is necessary for the performance of the contract. The tenant may object to receiving further information.

13. Applicable Law and Jurisdiction: Swiss law applies exclusively. The place of jurisdiction is the location of the rental property.
